kybecca wine and gourmet does not knowingly collect any personal information from minors, and we take steps to ensure that minors cannot purchase or receive alcoholic beverages from us. One of these steps is that any of our shipments that contain alcoholic beverages are sent with an "Adult Signature Required" sticker on them, and the common carrier that delivers our merchandise is required to ask and check for identification upon delivery. Wines may be sold and delivered only to a person who is at least 21 years old. Customer represents that: (1) Customer is at least 21 years old; and (2) the person to whom any wine will be delivered is also 21 years old. At the time of delivery, any shipment arranged by kybecca containing an alcohol beverage product will require the signature of an adult possessing identification proving he or she is at least 21 years old. Further the law requires that no delivery shall be made to a visibly intoxicated person. Shipping to a BUSINESS ADDRESS is strongly recommended.

Order Cancellations — Customers who cancel an order before the order has been shipped are subject to a restocking fee of 10% of the cost of the product.  Order Cancellations are not allowed after a product has been shipped and is therefore no longer in kybecca's possession.  For customers wishing to return wine that has already shipped, please see our return policy.

Wine Condition — kybecca makes every effort to ensure that our wine is of the highest quality. However, due to circumstances beyond our control it is impossible to guarantee the quality of each bottle. If you believe that your wine is contaminated, oxidized (or “cooked”), or has some other deficiency please see our Returns Policy. Price Changes and Availability — Kybecca reserves the right to change prices or availability of any product without notice. Kybecca also reserves the right to set minimum or maximum quantities for purchase.

Interstate Shipping — Due to laws and regulations that vary state by state, kybecca is not able to ship to every state. Please see out list of states where we can ship to see if we can ship to you.

Shipping Costs — Customer is responsible for all carrier fees incurred in shipping purchases to Customer's desired shipping address. To the extent that kybecca provides estimates of shipping, duties, and custom charges, these should be considered to be estimates only. In addition to the carrier’s own charges, kybecca charges $3 for one to five bottles and $6 for six to twelve bottles or more as a packaging fee. Wine must be shipped in special containers, and this fee is used to cover that cost.

Customer Pick Up — Any wine purchased from kybecca.com can be picked up at our retail store at 4264 Plank Road, Fredericksburg, Virginia. Customers wishing to pick up their wine can select that option at checkout. Please note that customers may not pick up wine purchased from the website at our retail location at 402 William Street, Fredericksburg, Virginia. This is due to Virginia law regarding alcohol pick up.

Prices — Prices of kybecca merchandise (which includes anything sold on the website) is subject to change at any time without notice.

Release — Customer agrees to release kybecca from any liability for any damage, injury or loss, monetary or otherwise that Customer incurs as a result of either Customer's or another party's use of kybecca’s website, services, products or third party references, except as expressly described herein. • Customer purchase of goods pursuant to this Agreement;
• Any use or alleged use of Customer accounts or passwords by any person, whether or not authorized by Customer;
• The content, quality or performance of content that Customer submits to kybecca websites
• User connection to kybecca websites;
• User violation of this Agreement; or
• User violation of the rights of any other person or entity, including without limitation intellectual property rights and rights of privacy and/or publicity

except to the extent that such liability is the direct result solely of kybecca's gross negligence or willful misconduct.

 

kybecca reserves the right, at kybecca's own expense, to assume the exclusive defense and control of any matter for which Customer is obligated to indemnify a kybecca Party, and Customer agrees to cooperate with kybecca's defense of these matters at no cost to kybecca. The foregoing obligations of Customer are hereinafter collectively referred to as "Indemnity Obligations." Indemnity Obligations shall survive, for a period of five (5) years, after the latest of a product sale or termination of kybecca's services under this Agreement. Each situation will be reviewed on an individual basis in light of facts and circumstances of that case and resolved promptly. Other than for kybecca errors, we generally cannot accept a return if title has been transferred to you for longer than 45 days because the passage of time generally limits our ability to recover credit from our supplier and we have no way of verifying your storage conditions.

Note that we may ask you to return questionable bottles (including both opened and unopened ones) to us for evaluation and for possible return to our supplier. Such bottles must have the original barcode label or the kybecca-generated barcode label attached as proof that the wine came from us. Should we accept responsibility (in our sole discretion), we will either exchange bottle(s) or issue a credit towards future purchases. Set forth below are examples of both valid and invalid reasons for returning wine, which are subject to kybecca’s investigation, review and final evaluation of the relevant facts and circumstances regarding a particular request for return.

• Corked or flawed wine. The winery, not kybecca, is the source of this problem but we understand it can be disappointing.
• Wrong wine was sent (e.g., different vintage than ordered)
• Wine is leaking upon arrival, spoiled or "cooked" (only if it was shipped in accordance with our shipping policy; we do not guarantee condition if you chose to override our shipping policy)
• Shipper errors - we'll file a claim against the shipper for you.

• You decide you don't want the wine after title has transferred to you but before the wine has been shipped from our warehouse.
• The wine is showing signs of damage after leaving our possession due to adverse weather conditions during shipment (where you have overridden our shipping policy), delays caused by failed delivery attempts through no fault of the shipper, improper storage, or other forms of mistreatment.
• You don't like the wine.
• You overbought and want to return excess wine.
• You received a gift from someone via kybecca.com and want to exchange it.

The following policy governs all domestic U.S. shipments of wine from kybecca through common carriers. This policy does not govern customer pickups.

kybecca is dedicated to ensuring that the value of wine you order from us is protected. That is why we have made this shipping policy as following the guidelines will minimize any possible damage to the wine. However, we understand that you may wish us to ship wine in a way that does not conform to our policies. For any shipment, you may request to override our policy at your own risk.

1. Monday/Tuesday shipping - All orders will be shipped on Mondays or Tuesdays to ensure the minimum time in transit and maximum likelihood that delivery will be complete before the following weekend. Exceptions are overnight shipments that are not Fridays, or shipments close enough to our storage facility that they will arrive at their destination before the weekend.
2. Next Day Air Service - kybecca recommends the use of Next Day air service or 2nd Day Air Service for all shipments outside of Virginia.  kybecca cannot guarantee that the wine has not been 'cooked' or leaking if you opt for any other service.
3. Weather Hold – In the case of severe weather conditions, ie freezing temperatures or very hot temperatures, we will place a hold on your shipment until the following week. Once the temperature is no longer severe we will make your shipment.
4. Initial weather hold notification - If your shipment is subject to a weather hold, you will be notified by email by close of business (Pacific Time) on your shipment date. Upon an initial weather hold, you may ask us to waive the hold by returning the email or calling Customer Service. If you do not respond, we will automatically attempt to ship the following week.
5. Second shipping attempt - By default, all orders on weather hold will be re-examined for adverse weather conditions the following week. If adverse weather conditions are still present, orders will again be placed on weather hold.
6. Second weather hold notification - If your shipment is subject to a second weather hold, you will again be notified by email by close of business (Eastern Time) on your shipment date. You may ask us to waive the weather hold by returning the email or calling (540) 548-3339. If you do not respond, we will continue to hold the wine until weather conditions have returned to normal, then send out the shipment.
7. Tracking numbers - Once your shipment has been sent, we will send you a tracking number and an estimated date of arrival.

1. Next day service - This ensures the minimum amount of transit time.
2. Only ship to a business address - We recommend that all shipments be sent to a business address or an address that is equipped to receive shipments during standard business hours. This ensures your shipment won't remain in vans or warehouse facilities overnight without temperature controls. Furthermore, our carrier will not leave a package containing wine or beer at your home if nobody of legal age is there to sign for it. They will make 3 delivery attempts and then if it is still undeliverable they will send it back to kybecca, at which point there is nothing kybecca can do except ship it out again at the customer’s expense. Shipping to a business with normal hours will help to ensure that the package is delivered on the first attempt.
3. Ensure the presence of a receiver of legal age - All kybecca packages containing wine and/or beer require a signature from someone who is 21 or older. Carriers will not deliver packages to under age persons and a failed delivery attempt will cause a delay in receipt and may introduce weather-related risk of damage.
4. Contact the carrier - If your ability to receive the package on the first delivery day changes, contact the carrier as soon as possible to make alternate arrangements.
